About these terms
1.1Who we are
Victor Plesco and Vladimir Sandic, private individuals, Elisabethstraße 32/5, 8010 Graz, Austria ("we"). Email: office@einmemo.com.
1.2Who may use Memo
You must be at least 18. Memo is for your own private use.
Memo
2.1The service
Memo is a contact in your messaging apps that remembers for you. It is in beta and free during the beta.
2.2Mistakes and advice
Memo is an AI. It reads only what you send it and can make mistakes, so check anything important. Memo gives no medical, legal or financial advice.
2.3Beta
During the beta, Memo may change, fail or be unavailable, and we may change what it does. The free beta gives you no right to Memo, or to a particular price, after the beta.
2.4Messaging apps
Memo runs inside messaging apps. Their own terms apply to your use of them. If an app limits or stops Memo, Memo may not be available there.
Signing up
3.1Your code
You sign up on einmemo.com with your email address. We send you a code that unlocks Memo. The code is personal and works once.
Emails and calendar invites
4.1Emails
Memo sends an email only when you ask for it. It first sends you a draft, and sends the email only after you confirm.
4.2Calendar invites
Memo sends a calendar invite as soon as you ask for it.
4.3Your responsibility
You are responsible for what you ask Memo to send, and to whom. An appointment you book through Memo is between you and the other party.
Your content
5.1What you send stays yours
We use it only to run Memo for you, and to fix and improve Memo.
5.2Other people
Send only what you are allowed to share, including other people's names, photos and details.
Restrictions
6.1What you must not do
- sign up with an email address that is not yours;
- automate the sign-up form, or pass on your code;
- access our systems without permission;
- use Memo to break the law, harass or deceive anyone, send spam, or overload it.
6.2If you do
We may cancel your code and limit or end your access.
Ending
7.1By you
You can end this contract at any time, without giving a reason and at no cost: stop using Memo, or write to office@einmemo.com. To have your data deleted, see the Privacy Policy.
7.2By us
We may end the beta, or your access, with reasonable notice by email or in the chat. We may end your access at once if you seriously breach these terms.
Warranty and liability
8.1Your statutory rights
Your statutory rights as a consumer, including the warranty for digital services, are not affected by these terms.
8.2Liability
We are not liable for slight negligence. This does not limit our liability for intent, gross negligence, personal injury, or anything else that cannot be limited under the law. If you are a consumer in Germany, we are also liable for slight negligence when we breach a duty that is essential to the contract, limited to the damage typical and foreseeable for this kind of contract.
General
9.1Changes to these terms
We may update these terms. If a change is important and we have your email address, we tell you before it applies.
9.2Law and courts
Austrian law applies, without its conflict-of-law rules and without the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in the EU, you keep the protection of the mandatory law of your country, and you may go to court there.
9.3Dispute resolution
We do not take part in dispute resolution before a consumer arbitration board.
